Eastbourne Solicitor Concerned Over LPA Changes

Solicitor, Antony Caulfield Partner, Private Client Services at Gaby Hardwicke Solicitors based in Eastbourne has warned against proposals to turn the lasting powers of attorney (LPA) registration process fully digital.

An LPA is a powerful legal document that allows a person to appoint trusted individuals to make important decisions about their finances and property on their behalf. The current process requires the physical signing of the document in the presence of an independent witness. But in a paper released on Thursday, the Financial Conduct Authority (FCA) called for a fully digital system, whereby documents could be registered completely online.

Antony said, “Lasting Powers of Attorney are very important, powerful and complex documents, which give far reaching powers to the attorneys that are appointed. I am extremely concerned with the proposal for the Lasting Powers of Attorney registration process, to become fully digital, as I firmly believe this will greatly increase the risk of fraud and financial abuse for thousands of vulnerable people.”
